In a major Medicare secondary payer (MSP) development, CMS’s new TPOC/WCMSA reporting requirement starts April 4, 2025. In a nutshell, starting April 4th, workers’ compensation insurers must report several WCMSA data points for WC settlements with Medicare beneficiaries through Section 111 TPOC reporting. This new process gives CMS unprecedented visibility into insurers' WCMSA practices. To ensure compliance, CMS’s enforcement recourses include auditing $0 MSA values and potential False Claims Act actions.
