TRIA Rules Filings for Commercial Lines and New Endorsement Options for Excess Lines

We've begun submitting state-specific filings revising various rules in the Commercial Lines Manual Terrorism Supplement, in response to the Terrorism Risk Insurance Program Reauthorization Act of 2015, under filing designation CL-2015-OTRRU. In addition, in circular LI-CU-2015-027, we announced multistate filing CL-2015-OTENF, which introduces additional exclusion of terrorism endorsements for the Commercial Excess Liability and Farm Excess Liability programs. An updated TRIA status report is attached, reflecting resolution of the 2015 TRIA commercial lines forms filing in all jurisdictions. (In Massachusetts, a new filing will be made to address Conditional endorsements, which were removed from the initial filing, as detailed in Circular LI-CL-2015-072.)

The ISO Terrorism filing in Massachusetts has been amended and approved. The amendment consisted of removing the Conditional forms (edition 01 15) from the filing; the Conditional forms will be resubmitted as a separate filing under regular filing procedure in the near future. A circular announcing the Massachusetts amendment and approval is forthcoming; the TRIA 2015 status report will be updated once that circular is released.

We released Circular LI-CL-2015-050, which provides a corrected filing exhibit for endorsement CG 21 82. The final (published) copy available on ISOnet was not affected by the error in the filing exhibit. Refer to the circular for full details.

According to a report on the NAIC Newswire, the Treasury Department is preparing to release guidance on the government's terrorism risk insurance program after President Barack Obama earlier this month signed into law legislation passed by Congress. “With the enactment of the Terrorism Risk Insurance Program Reauthorization Act of 2015, Treasury will provide guidance in the near future to address, on an interim basis, certain aspects relating to the implementation of the Program," said Michael McRaith, director of Treasury's Federal Insurance office.

Montana and Oregon have approved ISO’s multistate Commercial Lines filing, CL-2015-OTRFO. They are in addition to those states mentioned in earlier updates, that have also approved the filing. Arizona has approved a state-specific version of the filing, designated as CL-2015-OTRF1; circular LI-CL-2015-011 provides a copy of the filing and addresses approval as well.

Georgia has approved a state-specific version of the filing, designated as CL-2015-OTRF1; circular LI-CL-2015-013 provides a copy of the filing. An approval circular is under preparation.

Approval circular LI-CL-2015-007 has been released, addressing Alabama, Iowa, Maine, Michigan, North Dakota, South Dakota, and West Virginia.

The Terrorism Risk Insurance Program Reauthorization Act of 2015 (former H.R. 26) was signed into law by President Obama on January 12, 2015.

The Act reauthorizes TRIA through the end of 2020; makes various amendments to the certification decision process, financial participation percentages, and dollar amounts; requires various studies; and establishes certain data collection requirements. For more information, please read circular LI-AL-2015-003 (ISOnet login required).

We began submitting ISO multistate Commercial Lines filing CL-2015-OTRFO on January 9, 2015; filing activity is continuing. Refer to circular LI-CL-2015-005 for details (ISOnet login required). To date, four states have approved this filing, effective January 12, 2015: Alabama, Iowa, North Dakota, and South Dakota. Approval circulars will be released as usual.

ISO is filing revised terrorism forms in response to Congressional action to reauthorize the Terrorism Risk Insurance Act. The revised forms are being filed for insurer use in most states shortly after President Obama signs the bill, known as the Terrorism Risk Insurance Program Reauthorization Act of 2015 (H.R. 26), which is expected to happen shortly.
