The Centers for Medicare and Medicaid Services (CMS) has released a new alert entitled “2018 Recovery Thresholds for Certain Liability Insurance, No-Fault Insurance and Workers’ Compensation Settlements, Judgments, Awards or Other Payments." Through this alert, CMS has announced that it is maintaining the current $750.00 low dollar threshold in 2018 for certain settlement, judgments, awards or other payments.
CMS’ low threshold applies to (i) physical trauma-based liability insurance settlements of $750.00 or less and (ii) no-fault and workers compensations settlements of $750.00 or less, where the insurer does not otherwise have ongoing responsibility for medicals (ORM). Per CMS, “[t]his means that entities are not required to report, and CMS will not seek recovery on settlements as outlined above.” Excluded from this policy are liability (including self-insurance) settlements for alleged ingestion, implantation, or exposure cases.
